El Derecho del turismo en la Unión Europea Regulación actual, novedades normativas y propuestas de futuro: análisis de algunos aspectos problemáticos

Abstract

This study will analyse the regulation of tourism services by dividing them into three main categories: accommodation, transport and package holidays, which will in turn be examined in conjunction with the regulations on consumer protection and e-commerce – issues that are now inextricably linked in this field. We must start from a dual perspective: on the one hand, the different areas depending on the tourist services in question, and on the other, the two major sectors affected: the protection of tourists as consumers, and distance contracts and e-commerce. This approach is simply a reflection of the relevant legislation: why opt for siloed compartments when most tourism services are linked to the same issues? Why should one have to consult a multitude of regulations to find the legal regime applicable to a specific tourism service? The issues at hand, the changes occurring at various levels, the new needs arising from new tourism products, and the new technologies applied to tourism, these are the factors that will shape the development of this study, which focuses on an analysis of the relevant regulations, recent developments, and proposals for the future from a critical perspective, highlighting the problems and suggesting possible future solutions.
